Terms and conditions
Version: draft 1.0, [DATUM]
In brief
- Shirts N Stories sells second-hand football shirts. Every shirt is unique: there is only one.
- As soon as a shirt is in your cart, we hold it for you for 15 minutes.
- You have 14 days to change your mind after you receive the shirt. The cost of sending it back is for you.
- A legal guarantee applies to second-hand shirts. What we describe and show is not a defect.
- We deliver to all EU countries, within 2 working days, with tracking.
- Our sales fall under the margin scheme for second-hand goods. That is why your order shows no separate VAT amount.
- If we can't work it out between us, you can go to the Consumentenombudsdienst (the Belgian consumer mediation service).
1. Who we are
Shirts N Stories is the trading name of [NAAM], [ADRES], company number [ONDERNEMINGSNUMMER], [BTW-STATUS]. You can reach us at [E-MAIL] and (optionally) [TELEFOON]. By "we" and "us" we mean [NAAM], trading as Shirts N Stories. By "you" we mean the consumer: a natural person who buys a shirt for private use and not for their trade or profession.
2. What these terms apply to
- These terms apply to every order placed through [WEBSITE].
- They are meant for consumers. If you want to buy as a business, email us and we will agree separate terms.
- Our site exists in Dutch and English. The texts have the same content. If they differ, the version in the language in which you placed your order applies.
- These terms take nothing away from the mandatory legal rights you have as a consumer, even if you live in another EU country.
3. Our shirts and their description
- All shirts are second-hand and unique. There is only one of each shirt in our shop.
- For every shirt we state: the season, whether it is a home, away or third shirt, the size on the label, our own measurements (chest laid flat, length, shoulder), the material as on the care label, the condition according to our scale (Like new, Very good, Good or Worn) and photos of the label and of every detail that we describe.
- The photos show the shirt you will receive. Colours on a screen may differ slightly from the real colours.
- We describe every flaw or sign of use that we know of. What we describe and show is not a defect. If, on receipt, you find something that is not in the description or in the photos, that may be a defect. See article 9.
- Authenticity. We do not give an official guarantee of authenticity. We do describe as honestly as we can what we have checked and what we haven't. If we write that a shirt is original, we stand behind that. If we doubt it, you will read that with the shirt.
- Shirts N Stories is not connected with clubs, players or shirt brands. Club names, badges and brands on the shirts belong to their owners and are used only to describe the shirt.
4. Prices
- All prices are in euros and are the prices you pay, including all taxes.
- Our shirts are second-hand goods that we sell under the margin scheme for second-hand goods. That is why your order or invoice shows no separate VAT amount.
- The delivery cost is added to the price of the shirt and is shown in your cart and at checkout before you pay. The example rates are on the Delivery and returns page.
- You pay no extra charge for the payment method you choose.
5. Ordering and formation of the contract
- Step 1, cart. As soon as you put a shirt in your cart, we hold it for you for 15 minutes. After that it becomes available to everyone again. You can see the time remaining in your cart.
- Step 2, details. You enter your email address and delivery address, and choose a delivery method. A telephone number is optional. You can check and correct your details before you order.
- Step 3, overview. You see your order, the delivery cost and the total amount.
- Step 4, ordering. You click the button "Order with obligation to pay". With that click you confirm that your order carries an obligation to pay.
- Step 5, paying. You go to the secure payment page of Stripe and pay there.
- Step 6, confirmation. Once your payment has succeeded, we send you a confirmation by email. The contract is formed at the moment your payment has succeeded and we confirm your order.
- If your reservation expires before your payment comes in, and the shirt has meanwhile been sold to someone else, no contract is formed. We cancel your order and automatically refund the full amount (see article 6).
- If a shirt turns out not to be available after all because of a mistake on our side (for example because it was sold twice by mistake or was damaged during preparation), we cancel your order and refund everything.
- Your confirmation email contains your order number (format YYYY-NNNN, for example 2026-0001), the shirts you bought, our terms and conditions and information about your right of withdrawal, with the model form. Please keep that email. We also keep your order details ourselves for as long as the law requires, and you can request them at [E-MAIL].
6. Payment
- You can pay with Bancontact, iDEAL, Visa and Mastercard. You pay online on the payment page of our payment partner Stripe. We never see your bank or card details.
- You pay when you order. Your payment has to be in before your reservation ends.
- If your payment fails or expires, nothing has been charged. We send you an email with a link to try again, as long as the shirt is still available.
- If your payment only comes in after your reservation has expired and the shirt has meanwhile been sold, we refund the full amount using the same payment method, within [5] working days (example), and we let you know by email.
- We make refunds using the payment method you paid with, unless you expressly ask for something else and that can be done at no cost to you.
7. Delivery
- We deliver to all countries of the European Union. For the time being we don't deliver to countries outside the EU. Territories outside the EU's VAT or customs territory are excluded for the time being.
- We dispatch your order within 2 working days of your payment. The delivery time is usually 2 to 5 working days after dispatch, depending on the country. What we have agreed on the order page applies. Without another agreement, we deliver within 30 days of your order at the latest.
- We ship with [VERVOERDER], with tracking. You get the tracking link by email as soon as the parcel is on its way.
- Delivery costs (example, adjustable): Belgium and the Netherlands € 5.95, rest of the EU € 9.95. If you order several shirts at once, you pay delivery once, up to 3 shirts per parcel.
- Risk. Until you take delivery of the parcel, we are responsible for loss or damage. The risk passes to you as soon as you, or a third party whom you have named and who is not a carrier, take possession of the parcel.
- Check the parcel when it arrives. Is it damaged, or does it not arrive? Email us as soon as possible at [E-MAIL]; we will sort it out with the carrier.
- It is your responsibility that the delivery address is correct. If you notice a mistake, email us straight away.
8. Right of withdrawal (14 days to change your mind)
- You have 14 calendar days to withdraw from your purchase, without having to give a reason. The period starts the day after you, or a third party whom you have named and who is not a carrier, take delivery of the shirt. If your shirts are delivered in several parcels, the period starts the day after you receive the last parcel.
- You withdraw by sending us a clear statement before the end of the period. You can do this:
• through the button "Withdraw from the contract here" on [WEBSITE];
• by email to [E-MAIL];
• with the model form on the page Right of withdrawal and form.
We confirm your withdrawal straight away by email, with its content, the date and the time. - You send the shirt back no later than 14 days after you have told us that you are withdrawing, to [RETOURADRES].
- The direct cost of sending it back is for you.
- We refund everything you have paid us, at the latest 14 days after we learn of your withdrawal. That includes the delivery cost of the cheapest standard delivery that we offer. If you chose a more expensive delivery method, we don't refund the extra amount. We refund using the same payment method. We may wait to refund until we have received the shirt or until you show that you have sent it back, whichever happens first.
- You are liable for a loss in value of the shirt only if it results from handling that goes beyond what is needed to establish the nature, characteristics and functioning of the shirt. Trying it on is fine; wearing, washing or damaging it is not.
- The exceptions to the right of withdrawal (such as personalised goods or sealed hygiene goods) do not apply to our shirts.
- More information and the model form are on the page Right of withdrawal and form. Practical advice on the return is under Return policy.
9. Condition, authenticity and legal guarantee
- The shirt must match the description and the photos on the product page.
- Signs of use or age that we have described and shown are not a defect. At checkout you confirm that you have looked at the description and the photos and accept the deviations described.
- For our second-hand shirts the legal guarantee is 1 year, from delivery. The law allows this for second-hand goods, on condition that we tell you clearly beforehand. We do so on the product page and at checkout. By confirming your order, you confirm that you know this.
- If you later find a defect that was not in the description or in the photos, tell us as soon as possible and at the latest within 2 months of discovering it, at [E-MAIL], with photos.
- If the shirt does not conform to what was described, we can repair it, replace it, reduce the price or refund the purchase. Because every shirt is unique, replacement is often not possible; then there is a price reduction or a refund. This is free of charge to you, including the cost of sending it back.
- We do not offer a separate commercial guarantee on top of the legal guarantee.
- The guarantee does not cover damage that arises after delivery through wrong use or careless washing or storage.
10. Complaints and disputes
- Do you have a complaint? Email us at [E-MAIL] with your order number. We reply within [5] working days (example) and look for a solution together.
- If we can't work it out between us, you can go, free of charge, to the Consumentenombudsdienst (the Belgian Consumer Mediation Service), an autonomous public service that mediates between consumers and businesses: Koning Albert II-laan 8 bus 1, 1000 Brussels, https://consumentenombudsdienst.be, contact@consumentenombudsdienst.be.
- Do you live in another EU country? You can go there too, as a consumer with a dispute with a business established in Belgium. A list of mediation bodies in all EU countries is available at https://consumer-redress.ec.europa.eu.
11. Liability
We are liable as the law provides. Nothing in these terms limits a liability that the law does not allow to be limited, such as in the case of intent or personal injury.
12. Intellectual property
The texts, photos, stories and the logo on our site are ours. You may view them for personal use. For any other use you need our permission. Club names, badges and brands belong to their owners.
13. Personal data and cookies
You can read how we handle your data in the Privacy policy. What we store on your device is set out in the Cookie policy.
14. Applicable law and competent court
- Belgian law applies to these terms and to your order.
- If you live in another EU country, the mandatory consumer rights of your country also continue to apply where they give you more protection. Our terms do not take them away.
- In a dispute the Belgian courts have jurisdiction, without prejudice to your right as a consumer to bring a case before the court of your place of residence, where the law allows that.
15. Changes
An order is subject to the terms that applied when you ordered. We may change these terms later; the new version then applies to new orders.
16. Final provisions
If a provision in these terms is not valid or not enforceable, the other provisions remain in force. Questions? Email us at [E-MAIL].
